A private client installed external security shutters and a stone chimney to the rear elevation of an apartment scheme. An Enforcement Notice was subsequently served by Tameside Council requiring removal of the works. Hourigan Connolly advised the client that a split decision at appeal was likely and commensurate with our advice the Enforcement Notice was subsequently partially quashed on appeal with the shutters being allowed to remain in place and the chimney having to be removed.
