Following the refusal of outline planning permission Hourigan Connolly were appointed to provide expert witness services in relation to planning matters for an appeal that was heard by way of a Public Inquiry. The appeal was subsequently recovered by the Secretary of State.
Despite the site being located in a Strategic Gap and notwithstanding the recent adoption of a Neighbourhood Development Plan we were able to demonstrate that relevant Development Plan policies relating to the supply of housing were out-of-date being out-of-date and that the development was sustainable. The appeal was subsequently allowed by the Secretary of State and planning permission was granted for 165 dwellings in October 2016.
