Hourigan Connolly successfully overturned an Enforcement Notice against the unauthorised use of a previously developed site in a Landscape Conservation Area, adjacent to an Area of Outstanding Natural Beauty (AONB). The site was used for private holiday purposes which the owner sought to regularise through a retrospective planning application. After refusing the application, the Council took formal enforcement action against the continued use of the site. Hourigan Connolly appealed against the Enforcement Notice and provided expert advice at the Hearing. The appeal was allowed and the owner permitted to use the site for private purposes on a seasonal basis.
